Warranty

We warrant that for 10 years following the date of manufacture, the products will not de-laminate.  In the event de-lamination occurs, you must contact us by email at warranty@earthcoresips.com or phone (888) 299-3049, and send a photograph of the alleged defect for inspection, to initiate the warranty claim procedure.  In our discretion, in certain circumstances we may also request that you send the panel to us, at your cost, for further inspection.  If your claim is within the warranty period, and we determine that the product de-lamination is caused by a defect in our control, we will repair or replace the product at no cost to you. NO OTHER WARRANTY, EITHER EXPRESS OR IMPLIED, IS PROVIDED TO YOU OR ANY OTHER THIRD PARTY.

WE MAKE NO ADDITIONAL WARRANTIES AS TO THE PRODUCT OR THE CONDITION, QUALITY OR OPERATING CHARACTERISTICS OF THE PRODUCT OR ANY OTHER MATTER WHATSOEVER. WE SPECIFICALLY DISCLAIM AND EXCLUDE ANY WARRANTY OF MERCHANTABILITY AND ANY WARRANTY OF FITNESS FOR A PARTICULAR PURPOSE, AND YOU ACKNOWLEDGE THE SAME.

IN NO EVENT SHALL THE COMPANY OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, INCIDENTAL AND CONSEQUENTIAL DAMAGES, LOST PROFITS, OR DAMAGES RELATING FROM LOST DATA OR BUSINESS INTERRUPTION) RESULTING FROM THE USE OR INABILITY TO USE THE PRODUCTS PURCHASED FROM THE COMPANY OR THE SITE, WHETHER BASED ON CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT THE COMPANY IS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.  THE COMPANY SHALL ONLY BE LIABLE TO YOU FOR WILLFUL MALFEASANCE, AND ONLY TO THE EXTENT OF ACTUAL DAMAGES INCURRED BY YOU, NOT TO EXCEED THE LESSER OF TEN DOLLARS (US$10.00) OR THE AMOUNT YOU PAID FOR THE PRODUCT.  REMEDIES IN THIS AGREEMENT ARE EXCLUSIVE AND LIMITED TO THOSE EXPRESSLY PROVIDED FOR HEREIN.
